1. Introduction and Agreement

1.1 Binding Agreement. These Terms and Conditions & Comprehensive Legal Disclaimer (the “Terms”) govern your access to and use of TR8CE, a software-only subscription service available at tr8ce.app. “TR8CE,” “we,” “us,” and “our” refer to the current operator of the TR8CE service. TR8CE provides software subscription features only and does not sell, ship, broker, or process payment for any physical products, compounds, supplements, medicines, or laboratory materials. By accessing, launching, installing, saving, using, or interacting with TR8CE in any way, you agree to be legally bound by these Terms.

1.1a Entity Transition. We may later form, reorganize into, or transfer operation of TR8CE to a legal entity using the TR8CE name. If that occurs, we may assign or transfer these Terms, user accounts, subscriptions, service operations, and related rights and obligations to that entity. We will update these Terms to identify the applicable legal entity when appropriate.

1.2 Do Not Use if You Do Not Agree. If you do not agree to these Terms, or if you do not fully understand them, you must not access, use, rely on, save, install, or interact with TR8CE.

1.3 Age Requirement. You must be at least 21 years old to use TR8CE. By using TR8CE, you represent and warrant that you are 21 years of age or older and legally capable of entering into a binding agreement.

1.4 Local-First Web Utility. TR8CE is a local-first web utility. Certain calculations, workspaces, interface states, saved values, cadences, or user-created records may be stored locally in your browser, device, local storage, cache, or user-controlled environment. You are solely responsible for your device, browser, saved data, exports, reminders, calendar entries, and any values you enter or retain.

1.5 Material Condition of Access. Your agreement to these Terms is a material condition of access to TR8CE. TR8CE is made available only on the condition that you accept the limitations, disclaimers, waivers, assumptions of risk, and releases set forth in these Terms.

2. Neutral Mathematical Utility Waiver

2.1 Neutral Arithmetic Tool Only. TR8CE is a neutral mathematical utility intended strictly for educational, informational, arithmetic, unit-conversion, volumetric modeling, and in-vitro laboratory modeling contexts. TR8CE is a blank calculation engine that performs fixed mathematical transformations based solely on values entered, selected, adjusted, saved, or exported by you.

2.2 Not a Medical Device. TR8CE is not designed, intended, marketed, or provided as a medical device, clinical decision support tool, diagnostic tool, treatment tool, prescription tool, compounding tool, preparation guide, administration guide, adherence system, or therapeutic protocol system.

2.3 No Diagnosis, Treatment, Cure, Mitigation, or Prevention. TR8CE is not intended for the diagnosis, cure, mitigation, treatment, or prevention of any disease, condition, symptom, injury, disorder, or health state.

2.4 No Medical Advice. TR8CE does not provide medical advice, healthcare advice, diagnostic advice, therapeutic advice, pharmacological advice, dosing advice, compounding advice, preparation advice, injection advice, administration advice, safety advice, efficacy advice, or legal advice.

2.5 No Dosing Guidelines or Clinical Protocols. TR8CE does not provide dosing guidelines, recommended amounts, starting doses, titration schedules, cycles, stacks, routes, frequencies, clinical protocols, treatment plans, adherence plans, or substance-use instructions.

2.6 Blind Calculator. TR8CE is a blind calculator. It cannot and does not know, inspect, verify, test, confirm, validate, identify, or authenticate any physical vial, liquid, compound, medication, peptide, biologic, chemical, research material, label, concentration, source, sterility, purity, potency, legality, storage condition, or intended use.

2.7 No Substance Recommendation. TR8CE does not endorse, encourage, imply, suggest, recommend, validate, rank, compare, or authorize the use of any specific peptide, medication, biologic, chemical, compound, research material, or other substance for any human, animal, clinical, therapeutic, diagnostic, performance, cosmetic, or health-related purpose.

2.8 No User-Specific Judgment. TR8CE does not evaluate you or any other person. TR8CE does not consider body weight, age, sex, diagnosis, symptoms, conditions, contraindications, medications, medical history, route of administration, treatment goal, response, adverse events, or clinical context. Any output is purely mathematical and non-personalized.

2.9 Independent Professional Advice Required. You must consult a qualified licensed healthcare professional, pharmacist, laboratory supervisor, attorney, or other appropriate professional before making any health-related, clinical, laboratory, legal, safety, or substance-related decision.

3. Physical Real-World Liability and User Assumption of Risk

3.1 You Control All Physical Inputs. You are solely responsible for every real-world value, material, assumption, vial, label, liquid, unit, mass, volume, concentration, and physical object that you use, reference, possess, prepare, mix, dilute, handle, store, inject, ingest, administer, apply, discard, or otherwise act upon.

3.2 No Verification of Physical Materials. TR8CE does not verify and cannot verify the identity, authenticity, purity, potency, sterility, concentration, mass, volume, legality, labeling, source, contamination status, storage condition, degradation status, or suitability of any physical vial, liquid, compound, peptide, medication, biologic, chemical, or research material.

3.3 You Assume 100% Physical Risk. You assume 100% of the risk and liability for any physical mixing, dilution, reconstitution, preparation, transfer, drawing, injection, ingestion, administration, application, handling, storage, disposal, purchase, possession, or use of any substance. Any such activity occurs outside TR8CE and is your independent act.

3.4 TR8CE Does Not Instruct Physical Conduct. No screen, visual, line, notch, haptic, snap, streak, cadence, calendar export, value, unit, label, reference marker, or result in TR8CE is an instruction to physically mix, dilute, prepare, draw, inject, ingest, administer, apply, handle, or use anything.

3.5 Danger of Unit Confusion. You acknowledge that unit confusion can cause catastrophic mathematical and physical errors. Micrograms (mcg) and milligrams (mg) are not the same. 1 mg = 1,000 mcg. Confusing mcg and mg may produce a 1,000-fold error. You are solely responsible for verifying every unit, conversion, decimal place, mass value, liquid volume, label, and calculation.

3.6 Danger of Decimal and Volume Errors. You acknowledge that decimal placement, vial labeling, volume measurement, liquid measurement, concentration assumptions, and manual-entry errors can cause dangerous results. TR8CE does not detect all possible errors and does not guarantee that any output is accurate, complete, safe, lawful, or appropriate.

3.7 No Emergency Use. TR8CE must not be used in emergencies, clinical care, patient care, medication administration, treatment decisions, adverse-event management, or any time-sensitive health-related context.

3.8 No Controlled or Unlawful Use. You are solely responsible for complying with all applicable laws, rules, regulations, professional standards, institutional policies, import restrictions, prescription requirements, controlled-substance laws, compounding laws, and research rules. TR8CE does not authorize unlawful use of any substance or calculation.

4. Advanced UI and Workspace Feature Waiver

4.1 Express Feature Acknowledgment. You acknowledge and agree that TR8CE includes advanced visual, tactile, reference, productivity, workspace, and export features. These may include, without limitation, vial graphics, water-volume targets, “WE SUGGEST” notches, magnetic snapping, haptic vibration, digital syringe graphics, draggable plunger controls, “COMMON” dashed reference lines, day streaks, cadence labels, “Due today” lists, saved workspaces, and .ics calendar exports.

4.2 Educational Interface Conveniences Only. You expressly acknowledge that all such features are provided solely as educational interface conveniences within a user-directed mathematical workspace. They are not medical directives, medical devices, clinical decision support, prescriptions, treatment plans, dosing instructions, therapeutic recommendations, preparation guides, compounding instructions, injection instructions, adherence tools, medication schedules, or substance-use reminders.

4.3 Haptics and Magnetic Snapping

4.3.1 Precision and Accessibility Mechanics. Haptic vibration, magnetic snapping, detents, tick alignment, and related tactile or visual feedback are touchscreen precision and accessibility mechanics. They exist to help align a visual selector with measurement increments and to reduce touchscreen imprecision.

4.3.2 No Dosing Nudge. Haptic vibration or snapping does not mean that any volume, amount, plunger position, water notch, unit mark, reference line, or value is recommended, safe, effective, standard, common for you, medically appropriate, or suitable for real-world use.

4.3.3 No Medical Signal. Haptics and snapping do not encode medical judgment, therapeutic suitability, clinical priority, biological effect, route of administration, or substance-specific guidance. They are not signals to act physically.

4.3.4 Manual Control. You remain solely responsible for every value selected, adjusted, accepted, saved, exported, or acted upon. TR8CE does not select the value for you.

4.4 “WE SUGGEST” Water Notches

4.4.1 Arithmetic-Display Convenience. Any “WE SUGGEST” notch, water-volume target, ratio target, or similar visual annotation is based solely on arithmetic-display convenience, ratio readability, unit-scaling simplicity, or visual usability.

4.4.2 Not a Preparation Instruction. A “WE SUGGEST” notation is not an instruction to add water, mix liquid, prepare a vial, dilute a substance, reconstitute any material, draw liquid into a syringe, inject, ingest, administer, or apply anything.

4.4.3 No Biological Basis. A “WE SUGGEST” notation is not based on pharmacology, sterility, purity, potency, absorption, bioavailability, safety, efficacy, route, therapeutic purpose, medical judgment, or user-specific needs.

4.4.4 User Override. You may ignore, reject, modify, override, or independently verify any “WE SUGGEST” value. If you use or rely on it for any purpose, you do so solely at your own risk.

4.5 “COMMON” Reference Lines

4.5.1 Historical Data Visualization. Any “COMMON” dashed line, reference line, marker, historical value, public-consensus notation, or similar annotation is a non-user-specific data visualization. It is not generated for you and is not personalized to you or any other person.

4.5.2 Not a Starting Dose. A “COMMON” line is not a starting dose, recommended dose, safe dose, standard dose, effective dose, protocol, prescription, treatment plan, safety statement, efficacy statement, medical standard, clinical instruction, or instruction for human use.

4.5.3 No Adoption of Reference Data. TR8CE may display values drawn from internal, third-party, historical, public, or aggregated reference information for general educational context. TR8CE does not adopt, endorse, validate, verify, or recommend such reference information.

4.5.4 No Accuracy or Suitability Representation. TR8CE does not represent that any “COMMON” value or reference line is accurate, lawful, safe, effective, current, complete, medically appropriate, or suitable for any person, substance, route, or purpose.

4.5.5 Independent Evaluation Required. You are solely responsible for rejecting, ignoring, verifying, or independently evaluating any “COMMON” marker or reference information.

4.6 Day Streaks, Cadences, Due Today Lists, and Workspace Continuity

4.6.1 Productivity Features Only. Day streaks, cadence labels, recurring workspace intervals, “Due today” lists, saved workspaces, and related continuity features are productivity, organization, and math-workspace continuity tools only.

4.6.2 No Adherence Tracking. These features do not track medication adherence, substance use, administration, injection, ingestion, treatment, health behavior, symptom response, outcomes, side effects, or therapeutic compliance.

4.6.3 No Dosing Schedule. Cadence labels such as daily, EOD, weekly, or similar terms refer only to user-created workspace review intervals or organizational preferences. They do not mean that any dose, injection, administration, protocol, cycle, or substance action is due.

4.6.4 Due Today Means Workspace Review Only. A “Due today” item means that a saved mathematical workspace or user-created review item is scheduled for review. It does not mean that any substance action is due.

4.7 .ics Calendar Exports

4.7.1 User-Created Productivity Export. Any .ics calendar export is a user-created productivity export for reviewing a saved mathematical workspace. It is not a dosing schedule, treatment calendar, medication reminder, protocol reminder, cycle tracker, adherence tool, clinical follow-up system, or substance-use directive.

4.7.2 No Calendar-Based Medical Instruction. No calendar event, alarm, notification, cadence, or exported file from TR8CE is an instruction to use, prepare, mix, dilute, draw, inject, ingest, administer, apply, or handle any substance.

4.7.3 External Calendar Responsibility. Once exported, .ics files may be stored, displayed, modified, synced, transmitted, or triggered by third-party calendar software outside TR8CE. You are solely responsible for all third-party calendar behavior, alarms, reminders, modifications, interpretations, and downstream use.

4.8 BioVault Local Inventory Workspace

4.8.1 User-Created Local Math Inventory. BioVault is a local-first, user-created math workspace and inventory list. BioVault may allow you to save cards containing a user label, calculated concentration, amount remaining, doses-left count, user-set opened date, freshness status, use timestamp, and similar local workspace fields. All such information is created, selected, edited, interpreted, and maintained by you.

4.8.2 No Verification of Vials or Materials. BioVault does not identify, inspect, test, authenticate, verify, or validate any physical vial, compound, medication, peptide, biologic, chemical, liquid, label, source, sterility, purity, potency, storage condition, concentration, amount remaining, or legal status. Any saved BioVault card is only a user-created software record and does not prove that any physical object exists, is accurately labeled, is sterile, is pure, is potent, is lawful, or is safe.

4.8.3 No Preparation, Administration, or Use Instruction. BioVault does not instruct, recommend, authorize, or remind you to prepare, mix, dilute, draw, inject, ingest, administer, apply, or use any substance. The label “use a dose” or any similar action within BioVault means only that you are manually subtracting a user-entered mathematical value from a local inventory workspace. It is not confirmation of actual physical use and is not a directive to use anything.

4.8.4 No Freshness, Sterility, or Safety Warranty. Any freshness status, opened-date field, aging indicator, color state, or day-count shown in BioVault is a calendar-based local display derived from the date you entered. It is not a sterility determination, safety determination, expiration determination, potency determination, contamination assessment, storage assessment, or medical judgment. TR8CE does not know whether any physical material is fresh, sterile, stable, degraded, contaminated, expired, or suitable for any purpose.

4.8.5 Doses-Left Count Is Arithmetic Only. Any doses-left count is a mathematical division or subtraction display based solely on user-entered or user-selected values. It is not a recommendation that any number of doses exists, should be used, can be used, or is safe to use.

4.8.6 User Liability. You assume all risk for any BioVault value, label, card, date, freshness status, amount remaining, doses-left count, use timestamp, or physical action. You are solely responsible for independently verifying all physical materials, labels, units, dates, storage conditions, and real-world decisions.

4.9 Sites Generic Marker Workspace

4.9.1 Generic Diagram and Local Marker Tool. Sites is a local-first, user-created visual marker workspace. It may display generic body diagrams with fixed marker spots such as abdomen, thigh, or other general areas. A marker tap stores only the generic marker selected, the timestamp, and the generic diagram view selected, such as male/female, front/back, or similar generic template information.

4.9.2 Not an Injection Instruction. Sites does not instruct, recommend, authorize, validate, or remind you to inject, ingest, administer, apply, prepare, or use any substance. No marker, glow, fade, color, timestamp, diagram, spacing indicator, or rotation display is an instruction to take any physical action.

4.9.3 No Clinical Site Selection. Sites does not select an injection site, recommend an anatomical site, evaluate anatomy, assess tissue condition, determine safety, identify contraindications, measure healing, detect reactions, assess adverse events, or provide clinical site-rotation guidance. Any marker reflects only your own manually selected local note.

4.9.4 No Substance, Dose, or Outcome Data. Sites does not require or verify what substance, if any, was associated with a marker. Sites does not ask whether you injected, what you injected, what amount was used, whether an effect occurred, whether an adverse event occurred, or whether any marker corresponds to a real-world act.

4.9.5 Glow and Fade Are Visual Workspace Aids Only. Any glow, fade, color, or time-decay effect in Sites is a generic visual workspace aid based on elapsed time from the marker timestamp. It is not a medical assessment, tissue assessment, healing indicator, safety indicator, site-readiness indicator, or clinical instruction.

4.9.6 Local-Only User Custody. Sites data is intended to remain in your own browser, device, local storage, cache, or exported materials unless a separate feature expressly states otherwise. You are solely responsible for clearing, deleting, exporting, securing, or interpreting Sites data.

4.9.7 User Liability. You assume all risk arising from any Sites marker, timestamp, diagram selection, glow, fade, spacing aid, interpretation, or real-world action. TR8CE is not responsible for any physical action you take outside TR8CE.

4.9.8 Timing Labels Are Descriptive Only. Any label such as “oldest marker timestamp,” “longest since last tap,” “recently tapped,” “cool,” “glow,” “fade,” or similar Sites display reflects only elapsed time since a user-created marker tap in local storage. Such labels do not identify a “best,” “safe,” “ready,” “recommended,” “rested,” or medically appropriate site. TR8CE does not recommend where to inject, whether to inject, whether any anatomical area is suitable, or whether any location should be used or avoided. If no prior marker history exists, any Sites display is only a blank or neutral workspace state and must not be interpreted as a location recommendation.

5. User Responsibilities and Prohibited Uses

5.1 User-Generated Inputs. You are solely responsible for every value, assumption, label, compound name, workspace, cadence, export, note, reference, and interpretation that you enter, select, view, save, rely on, or act upon.

5.2 No Human-Use Protocols. You agree not to use TR8CE to create, validate, request, publish, share, follow, operationalize, or encourage any human-use dosing protocol, therapeutic regimen, injection schedule, cycle, stack, titration plan, treatment plan, medication plan, or administration plan for any unapproved substance, medication, peptide, biologic, chemical, or research compound.

5.3 No Medical Reliance. You agree not to rely on TR8CE, including its haptics, snapping, suggested notches, “COMMON” markers, streaks, cadences, “Due today” lists, reference values, or calendar exports, as a source of medical, dosing, preparation, compounding, injection, therapeutic, safety, efficacy, or administration guidance.

5.4 No Misuse of Reference Data. You agree not to interpret any reference annotation, historical value, internal reference library value, public-consensus marker, or “COMMON” line as a recommendation that any person use any substance or amount.

5.5 No Circumvention. You agree not to remove, bypass, obscure, misrepresent, automate around, scrape, suppress, or disable any disclaimer, warning, acknowledgment, feature explanation, or safety notice within TR8CE.

5.6 No Resale or Clinical Deployment. You may not market, resell, sublicense, provide, deploy, embed, white-label, distribute, or use TR8CE as a clinical tool, patient tool, dosing tool, medical device, medication-management system, pharmacy tool, healthcare service, treatment platform, or administration scheduler.

5.7 No Professional Reliance. If you are a healthcare professional, researcher, lab worker, vendor, trainer, coach, consultant, or any person acting in a professional capacity, you agree that TR8CE is not a substitute for your professional judgment, legal obligations, institutional policies, professional standards, or regulatory duties.

6. No Reliance, No Warranty, and No Guarantee

6.1 No Reliance. You agree that you will not rely on TR8CE for any physical, medical, clinical, therapeutic, diagnostic, legal, laboratory, safety, or substance-related decision. You must independently verify all calculations, values, units, assumptions, source materials, labels, and decisions.

6.2 As-Is and As-Available. TR8CE is provided “as is,” “as available,” and “with all faults.” TR8CE makes no warranty of any kind, express or implied.

6.3 No Accuracy Warranty. TR8CE does not warrant that any calculation, conversion, display, haptic, snap, notch, marker, reference value, workspace, cadence, calendar export, or output is accurate, complete, current, safe, reliable, lawful, uninterrupted, error-free, or fit for any particular purpose.

6.4 No Fitness for Medical or Physical Use. TR8CE expressly disclaims any warranty of merchantability, fitness for a particular purpose, fitness for medical use, fitness for laboratory use, fitness for clinical use, fitness for therapeutic use, non-infringement, accuracy, title, and quiet enjoyment, to the maximum extent permitted by law.

6.5 No Availability Guarantee. TR8CE may be modified, updated, interrupted, suspended, restricted, or discontinued at any time without notice.

6.6 No Security or Data Guarantee. Local-first storage, browser storage, cache, exported files, calendar exports, saved workspaces, and device-level data may be lost, altered, corrupted, exposed, synced, copied, deleted, or accessed by third-party systems. You are solely responsible for backups, privacy, security, and downstream handling of your data.

7. Assumption of Risk and Release of Claims

7.1 Full Assumption of Risk. You knowingly, voluntarily, and expressly assume all risks arising from or relating to your access to, use of, interpretation of, reliance on, misuse of, export from, or actions taken after using TR8CE.

7.2 Independent Real-World Conduct. You acknowledge that any real-world action outside TR8CE, including any purchase, possession, handling, mixing, dilution, reconstitution, preparation, drawing, injection, ingestion, administration, application, storage, disposal, or use of any substance, is your independent conduct and not conduct directed, recommended, authorized, or controlled by TR8CE.

7.3 Release of TR8CE. To the maximum extent permitted by law, you release, waive, discharge, and covenant not to sue TR8CE and its operator, owners, officers, employees, developers, contractors, affiliates, licensors, service providers, agents, successors, and assigns, including any legal entity to which the TR8CE service is later assigned or transferred (collectively, the “Released Parties”) from any and all claims, liabilities, demands, damages, injuries, losses, costs, expenses, causes of action, regulatory consequences, or disputes arising out of or relating to:

7.4 Known and Unknown Claims. This release applies to known, unknown, suspected, unsuspected, disclosed, and undisclosed claims, whether existing now or arising later, to the maximum extent permitted by law.

7.5 California Civil Code Section 1542 Waiver. If California law applies, you expressly waive California Civil Code Section 1542, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in the creditor’s or releasing party’s favor at the time of executing the release and that, if known by the creditor or releasing party, would have materially affected the creditor’s or releasing party’s settlement with the debtor or released party.” You understand and agree that this waiver means you may be giving up claims you do not currently know about.

8. Limitation of Liability

8.1 No Indirect Damages. To the maximum extent permitted by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, enhanced, personal-injury, bodily-injury, emotional-distress, lost-profit, lost-data, lost-use, regulatory, or reputational damages arising out of or relating to TR8CE.

8.2 Maximum Liability Cap. To the maximum extent permitted by law, the aggregate liability of the Released Parties for any claim arising out of or relating to TR8CE will not exceed the greater of: (a) the amount you paid TR8CE for access to TR8CE during the three months before the event giving rise to the claim; or (b) $100.00.

8.3 Essential Basis of the Bargain. You acknowledge that TR8CE would not provide TR8CE without these limitations of liability, disclaimers, waivers, and releases.

9. Indemnification

9.1 User Indemnity. You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, demands, actions, proceedings, investigations, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

9.2 Regulatory and Enforcement Costs. Your indemnity includes, to the maximum extent permitted by law, costs arising from any inquiry, complaint, investigation, enforcement communication, subpoena, demand, inspection, or allegation caused by your misuse of TR8CE, your public statements about TR8CE, your sharing of TR8CE outputs, or your use of TR8CE in connection with any physical substance.

10. Intellectual Property and License

10.1 Ownership. TR8CE, including its software, interface, graphics, vial layout, syringe layout, plunger controls, haptic patterns, snapping mechanics, reference annotations, text, design, workflows, calculations, documentation, branding, logos, trade dress, and all related intellectual property, is owned by TR8CE or its licensors.

10.2 Limited License. Subject to these Terms, TR8CE grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use TR8CE for personal educational arithmetic and in-vitro modeling purposes only.

10.3 Restrictions. You may not copy, modify, reverse engineer, scrape, reproduce, distribute, resell, sublicense, exploit, frame, mirror, build derivative works from, or use TR8CE for any unlawful, medical, clinical, therapeutic, or commercial dosing purpose.

11. Community, Sharing, and Exported Materials

11.1 User Responsibility for Shared Materials. If TR8CE permits saving, sharing, exporting, copying, or transmitting calculations, workspaces, images, links, values, calendar files, or other materials, you are solely responsible for all such materials and all downstream uses.

11.2 No Adoption by TR8CE. TR8CE does not adopt, endorse, validate, verify, recommend, or assume responsibility for any user-generated, user-shared, exported, or third-party material.

11.3 No Medical Sharing. You may not share TR8CE outputs as medical advice, dosing guidance, substance-use instructions, therapeutic protocols, injection schedules, or clinical recommendations.

12. Changes to TR8CE and These Terms

12.1 Product Changes. TR8CE may update, modify, add, remove, suspend, or discontinue features, functions, displays, warnings, disclaimers, storage methods, exports, or access at any time.

12.2 Terms Changes. TR8CE may modify these Terms from time to time. Continued use of TR8CE after updated Terms are posted or presented constitutes acceptance of the updated Terms.

12.3 Re-Consent. TR8CE may require you to re-acknowledge these Terms, including feature-specific waivers, before continued access.

13. Governing Law, Venue, and Dispute Resolution

13.1 Governing Law. These Terms and any dispute arising out of or relating to TR8CE will be governed by the laws of the State of Oregon and applicable federal law, without regard to conflict-of-law principles.

13.2 Venue. Subject to any arbitration clause or other dispute-resolution process adopted by TR8CE, you agree that any judicial proceeding arising out of or relating to TR8CE or these Terms must be brought exclusively in the state or federal courts located in Oregon, and you consent to personal jurisdiction and venue in those courts.

13.3 Injunctive Relief. TR8CE may seek injunctive or equitable relief in any court of competent jurisdiction to prevent misuse, intellectual-property violations, unlawful conduct, regulatory harm, or reputational harm.

13.4 Class Action Waiver. To the maximum extent permitted by law, you agree that any dispute must be brought only in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, representative, private attorney general, or mass action.

13.5 Jury Trial Waiver. To the maximum extent permitted by law, you and TR8CE knowingly and voluntarily waive any right to a jury trial in any dispute arising out of or relating to TR8CE or these Terms.

14. Severability and Interpretation

14.1 Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

14.2 Maximum Enforceability. Each disclaimer, waiver, release, limitation, and indemnity in these Terms must be interpreted to provide the maximum protection to TR8CE permitted by law.

14.3 No Waiver. Failure by TR8CE to enforce any provision of these Terms is not a waiver of any right or provision.

14.4 Headings. Headings are for convenience only and do not affect interpretation.

16. Final User Acknowledgment

By accessing or using TR8CE, you expressly acknowledge and agree that:

  1. You are at least 21 years old.
  2. TR8CE is a neutral mathematical utility for educational, informational, arithmetic, and in-vitro modeling purposes only.
  3. TR8CE is not a medical device and does not provide medical advice, dosing guidance, clinical protocols, treatment plans, preparation instructions, injection instructions, adherence tracking, or therapeutic recommendations.
  4. Haptics and magnetic snapping are touchscreen precision and accessibility mechanics, not dosing nudges.
  5. “WE SUGGEST” water notches are arithmetic-display conveniences, not compounding or reconstitution instructions.
  6. “COMMON” dashed lines are non-user-specific historical data visualizations, not therapeutic starting doses.
  7. Day streaks, cadences, “Due today” lists, and .ics calendar exports are mathematical workspace productivity tools, not medical adherence trackers or dosing schedules.
  8. TR8CE cannot verify any vial, liquid, compound, peptide, medication, biologic, chemical, source, purity, sterility, potency, concentration, label, or physical material.
  9. You assume 100% responsibility for all inputs, interpretations, calculations, exports, physical materials, and real-world actions.
  10. You release TR8CE and the Released Parties from claims to the maximum extent permitted by law.
  11. If you do not agree, you must not use TR8CE.
